By subscribing to Club Y services or products you agree to the following terms and conditions:
1. Instruct Club Y to record and/or supply your relevant contact information and order details provided for that purpose to the provider, publisher or distributor of any product or service you have subscribed for and agree that your personal details including name, address and email address shall also be held by the relevant provider, publisher or distributor. You agree to familiarise yourself with these terms and conditions and details of their privacy policy so that you are aware.
2. Gold Membership entitles you to receive a Club Y Gold Membership card bearing related entitlements and privileges. A Gold Membership is individual and is not transferrable from one person to another. Gold Membership and its related entitlements and privileges applies to the individual nominated on the card. Where two (2) or more names have been printed on the application and/or card, the Membership and benefits will only apply to one person, being the first name listed on the card. Membership dues are non-refundable.
3. Agree that all information about any product or service on the Club Y Website is provided by the provider, publisher or distributor of that product or service and that Club Y has no responsibility for the accuracy of that information and is not liable for any errors or omissions in that information.
4. Agree that the products or services offered through the Club Y Website are offered by the provider, publisher or distributor of those products or services, and that any contract for the subscription for a product or service is between you and the provider, publisher or distributor of that product or service and that Club Y is not a party to that contract except where Club Y is the direct provider.
5. Agree that Club Y and its employees, agents, representatives, and other Gold Members will not be liable in contract or tort (including negligence), equity or on any other basis to you or any other person for any loss, injury or damage arising from or as a consequence of any act or omission by Club Y or any person providing services through the Club Y Website.
6. Agree that all offers made, contracts concluded and services provided through the Club Y Website shall be deemed to be made and provided in Australia notwithstanding the location of you or the provider, publisher or distributor of any product or service or any other person, shall be governed exclusively by Australian law, and the exclusive jurisdiction of the Courts of New South Wales in Australia who shall have exclusive jurisdiction to determine any such matters involving or alleged to involve Club Y.
7. Agree to provide your correct and full name, address and email address, as it will be held by Club Y in their online member database for the purpose of efficiency in member contact, assistance and Club Y e-news distribution. You also agree to the terms and conditions of Club Y's privacy policy contained on the Club Y Website.
8. The Club Y Online website reserves the right to remove any postings to the website and/or discussion forums which contain expletives or foul language, which are considered to be discourteous or which otherwise the Directors of Club Y or Yamaha Motor Australia in their sole discretion consider to be inappropriate for inclusion in these areas, and this may be done without any prior notice to the person who has contributed that posting.
9. Club Y Pty Ltd reserves the right to suspend or cancel the registration and or Membership of any user who contravenes any of the terms and conditions that apply to use of this website and the discussion forums.
10. As a registered user you consent to the receipt of emails from Club Y containing information and offers about products and services available through Club Y and the Club Y Website.
11. As a registered user you acknowledge that Club Y may vary these Standard Terms and Conditions at any time and agree that you are responsible for regularly reviewing these Standard Terms and Conditions. Any variations become effective on posting and you agree to be bound by any such modifications.
12. Agree that, to the extent permitted by law, Club Y and/or its suppliers exclude all liability for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including without limitation, damages for loss of life, data or profits, arising out of or in any way connected with the use or performance of Club Y, it's activities and it's website and, the delay or inability to use the Club Y Website, the provision of or failure to provide goods or services, or any information, software, products or services obtained through the Club Y Website.
13. Purchases. Where you make a purchase through Club Y, whether through this website, by telephone, email or direct sale you are bound by the Club Y Terms of Sale in relation to that purchase.
